The order comes before Sharma retires on September 30. The petitioner's counsel has submitted call data records and some photographs in support of his allegations that Sharma had maintained contact with the accused. Sandeep had filed a writ petition before the Bombay high court last week complaining that the crime branch had not probed Sharma's alleged role.
The division bench of Justice BP Colabawala and Justice Naresh Patil, while disposing of Lahoria's petition, directed that an assistant commissioner of the crime branch should record Sandeep's statement. Earlier the crime branch had given a clean chit to Sharma.
