Lok Adalat settles claim in 6 months

MUMBAI: The Lok Adalat negotiation exercise under District Legal Services Authority (DLSA), Thane on Saturday concluded with a landmark decision being passed within a record time of six months since the case entered the Motor Accident Claim Tribunal (MACT) at Thane court. Disposing the case of a motor accident victim from Kanjurmarg, the MACT panel under retired judge S A Dwivedi passed the judgement while compensating the relatives Rs 79 lakh.

SBI General Insurance was asked to pay amount of Rs 79 lakh to the victim's wife. "This case has set a benchmark in the MACT history, thus disposing the matter in a record time. The amount happens to be huge. Both the insurance firm and the family of the victim agreed for an early mutual settlement with a negotiated amount of Rs 79 lakh, based on the investigator's report of said accident," said Himanshu Thanawala.


Surprisingly, when the panel questioned the victim's mother about her expected share in the compensation she vehemently refused to accept a single penny. She even submitted an undertaking before the panel for no claim and urged the court to direct the entire amount to her grandsons and daughter-in-law.


"I lost my son which was my biggest asset. Money can't bring my son back which is why I did not claim my stake," said an emotional Parvati Kangralkar (67), mother the deceased Shantaram. "We had filed the case on December 19, claiming for Rs 1 crore compensation based on victim's monthly income of Rs 80, 000," said G A Vinod, advocate for the victim.


The victim Shantaram Kangralkar (37), a resident of Kanjurmarg, was returning home from work in an autorickshaw at 11pm on November 12, 2013 when he was crushed to death by an SUV at Vikhroli-Kanjurmarg junction. Fortunately, the auto driver survived with minor injuries.


"My husband, who was an interior designer, was the sole bread winner. When the accident took place we were all in our native village at Khopoli to celebrate Diwali but the shocking news played spoilsport. Now I have to upbring my two school going sons Tanmay (13) and Ayush (10) and take care of my mother-in-law with this amount, being a homemaker," said Manisha (36), wife of the victim.
