Hold special drive during Maha elections against illegal political banners: HC directs civic bodies

MUMBAI: Taking note of the increase in illegal political banners and hoardings before the ensuing State assembly elections, the Bombay High Court on Tuesday directed all municipal corporations and councils in Maharashtra to immediately commence a special drive and pull down those which do not have permission. The court said the drive shall continue until ten days after the elections results are declared.

The division bench of Justice Abhay Oka and Justice Girish Kulkarni passed the directions on a clutch of public interest litigation complaining of complete inaction of the authorities in removing illegal banners and hoardings. On August 7, the court had issued notices to political parties and leaders including of Congress, Shiv Sena and Maharashtra Navnirman Sena asking if they are ready to undertake, like National Congress Party and Bharatiya Janata Party not to put up illegal banners, hoardings etc.


MNS president Raj Thackeray filed an affidavit personally undertaking that he "will not allow or encourage his party workers to put up illegal and banner, shall cooperate and not cause obstruction to their removal." His affidavit was submitted to the court by senior advocate Srihari Aney alongwith an affidavit by the party's secretary and MLA Bala Nandgaonkar.


The judges also observed that the compliance reports filed by various civic bodies with regard to steps being taken for implementing the court's August 6 order ``but as of today there is no substantial compliance."' They granted time until November 24. and made it clear that ``that in the event the court finds that there is no compliance, appropriate action will have to be intiated against the municipal authorities. "They judges also directed that the civic bodies provide numbers to complaints , including anonymous ones, received on toll free numbers or by way of sms and to maintain a register of date, time and action taken on them.
