A division bench of Justice S J Vazifdar and Justice Anil Menon was hearing a petition by Team One Architects India Pvt Ltd, whose conceptual design was declared the winning design in 2009 but was subsequently discarded. Team One had moved the HC to restrain the state government from implementing any other design and from inviting bids for construction.
The state earlier informed the court that an attempt to resolve the dispute amicably had failed. The court was also told that the new project was at a different site and on a larger area than the one designed by the petitioner company and would have a library and an aquarium.
Petitioner's advocate Sunip Sen argued that new tenders are now being invited. He said his client was appointed although a formal contract was never signed.
"At the end of the day, it is a contract already awarded to me," he said. But the judges questioned his claim of a contractual agreement.
The next hearing is scheduled on August 20.
