Argument in telephone operator rape case begins

MUMBAI: Special public prosecutor Ujjwal Nikam initiated final arguments in the telephone operator gang-rape trial on Thursday. The rape which occurred at the derelict Shakti Mills premises was by young men whose behaviour disclosed that it was their regular haunt and manner of sexually assaulting girls, he said.

Nikam had earlier wrapped up with the last witness in the other gang-rape case being tried simultaneously, that of a photo journalist.


In the telephone operator's case, Nikam informed principal judge Shalini Phansalkar-Joshi that both the trials were complete within four months since the first witness was examined. There were 31 witnesses examined in the telephone operator's case and 44 in the case of the photo journalist.


The telephone operator and her prospective husband, said Nikam, had come to Mahalakshmi station as they wanted to go to the Mahalaxmi temple but did not know the way. "A passer by told them of a short cut which they chose and landed in trouble."


Accused Kasim and Salim accosted them and began beating them. Kasim took Salim's phone and made a call where he said "Maal aaya hain spot pe aja phataphat." At once then two other accused Vijay Jadhav and Asfaq arrived. All four started beating the two and one juvenile came on the scene too and their collective acts lead only to one conclusion that it was their regular way of assaulting girls, said Nikam. To emphasise on their criminal nature, he said they used code language typical of such anti socials thereby disclosing their conspiracy.


The couple, meanwhile, was traumatised and the girl unable to face her mother, left home and the city and went to Chattisgarh. She called up her mother from there to say she was okay but could not reveal things over the phone. Her mother had by then lodged a missing complaint with the police after the July 31, 2013 crime. A month later the girl arrived and lodged an FIR.


Nikam had examined nodal officers from mobile companies and showed that the call made from Salim's phone matched the time the girl had mentioned.


There is "ample corroborative evidence" Nikam said. He will continue on Friday.
